GACC| Solicited Public Opinions on Import & Export Food Safety

On June 12, GACC issued the Administrative Measures on Import and Export Food Safety (draft for comments) (hereinafter referred to as the Draft), which is open to public consultation for comments. The deadline for comments is July 11, 2020.

 

The Draft contains six chapters, covering food import, food export, supervision and management, legal liability, etc. Compared with the current Administrative Measures on Import and Export Food Safety, the chapters are basically the same, but the content has been greatly revised. Antion summarized the changes that have a greater impact on imported food companies. The specific contents are as follows:

 

1. The labels in Chinese for imported health food and special dietary food must be printed on the minimum sales package and shall not be affixed. In addition to the previous clear stipulation that formula milk powder for infants and young children shall not affixed Chinese label, complementary foods for infants and young children, foods for special medical purposes, sports nutrition food, food supplement for pregnant women and nursing mothers and other special dietary foods and health foods will also be prohibited affixed Chinese label.

 

2. Cancel the full inspections of the first imported dairy products. The "Measures for the Supervision and Administration of Inspection and Quarantine of Imported and Exported Dairy Products" is abolished. The "first-time imported dairy products should provide the test report of the items listed in the corresponding national food safety standards" will be also abolished.

 

3. Import certification materials are required, including but not limited to: (1) Declaration of conformity or guarantee of conformity; (2) Laboratory inspection report; (3) Certificate issued by the competent department of the exporting country (region) or its authorized institution; (4) Other qualification certification materials that should be had for food imports.
