Announcement of SAMR on Further Standardizing the Labeling of IF

In order to further standardize the labeling of infant and young children formula milk powder products, urge the enterprises to implement their main responsibilities and protect the legitimate rights and interests of consumers, in accordance with the Food Safety Law of the People's Republic of China and the Law of Protection of Consumer Rights and Interests of the People's Republic of China, the relevant matters are hereby announced as follows:

1. The label of infant and young children formula milk powder product should comply with the related regulations of food safety laws, regulations, standards and product formula registration. The labeling content should be true, accurate, clear and easy to distinguish, and should not contain false, exaggerated, misunderstood words, pictures or absolute content.

2. Content claim and function claim are not allowed in Infant formula milk powder (0~6 months). It is not allowed to conduct content claim and function claim for the essential ingredients in older infants and young children milk powder (over 6 months), but it is allowed to conduct content claim and function claim for optional ingredients that are permitted by national food safety standards on non-principal display panel in the form of words.

3. The principal display panel of the product label should indicate the product name, net content (specification) and registration number, can match pictures that meet the requirements of national food safety standards and does not cause misunderstanding of consumers, registered trademark can be marked on the corner of principal display panel and other contents cannot be marked on the principal display panel.

4. If there is a certain animal source in the product name, the source of the raw milk, milk powder, whey powder and other milk protein should all come from the animal species. If two or more than two kinds of animal sources are used in the same milk protein ingredients, the ingredient lists should be marked the proportions of various animal source ingredients.

5. The compound ingredients in the ingredients list should be marked in strict accordance with the requirements of national food safety standards. If an ingredient is itself the product of two or more ingredients (not including the compound food additives), such a compound ingredient may be declared, as such, in the ingredients list, provided that it is immediately accompanied by a list, in brackets, of its primary ingredients in descending order of proportion.

6. The recommended consumption or feeding recommendations on the product label should have a scientific basis, the words are rigorous, and the words like "must", "strict" are not allowed.

7. Social organizations such as industry associations should strengthen their self-discipline, guide and supervise the enterprises to standardize the product labeling and publicity claims. If any organization or individual is found to be involved in violation of this announcement or infringement of consumer rights, a complaint and report can be made through the 12315 hotline and the national 12315 platform.

From the date of this announcement, the application for registration of formulas of infant and young children formula milk powder products shall be carried out accordingly. From February 22, 2023, the labeling of products produced shall meet the requirements of this announcement. Products produced before can be sold until the end of the shelf life.
