SAMR Published Typical Cases of Law Enforcement

The SAMR has published 30 typical cases of “100-day action” law enforcement, including a number of false publicity and illegally publicity cases.


Ⅰ Tianjin Bailesi Biotechnology Development Co., Ltd. false publicity was investigated


Basic case: The party publicized the products "Selenium-enriched malt powder" and " Nuoli liquid ", using advertising slogans such as anti-cancer, anti-oxidative aging, improving throat function, repairing cells, sleep improvement , enhancing immunity and other terms. After the verification, “Selenium-enriched malt powder” and “Nuoli liquid” are common foods, and the above-mentioned claims are fictitious.


Legal basis and punishment: The above-mentioned violates the provisions of Article 8, paragraph 1 of the Anti-Unfair Competition Law. According to the provisions of Article 20, paragraph 1 of the Anti-Unfair Competition Law, the party is ordered to stop the illegal acts and impose a fine of 200,000 yuan. 


II Shenzhouxianglong (Beijing) Business Service Co., Ltd. illegally publicity was investigated


Basic case: The party manages crocodile-related products such as crocodile bone wine, crocodile meat, crocodile drink, etc., and declares that “crocodile does not have cancer for life”, and “the blood contains extremely rich enzymes, which has strong inhibition and killing of tumor cells”, and "crocodile serum can kill HIV", and other advertising slogans that are inconsistent with the facts.


Legal basis and punishment: The above-mentioned violates the provisions of Article 11, paragraph 2 of the Advertising Law of the People's Republic of ChinaAccording to Article 59 of the Advertising Law, the party is ordered to stop publishing illegal advertisements immediately and impose a fine of 50,000 yuan.


III Houchengdejian Trading Co., Ltd. posting an advertisement related to disease treatment function was investigated


Basic case: The party promoted products on the network, using advertising slogans such as “improving human immunity, preventing cancer, detoxification, blood pressure reduction.


Legal basis and punishment: The above-mentioned violates the provisions of Article 17 of the Advertising Law. According to Article 58 of the Advertising Law, the party is ordered to stop publishing illegal advertisements immediately and impose a fine of 150,000 yuan.
