The State Administration for Market Regulation recently deployed key legislation work for 2023 to strengthen the rule of law in market regulation.

In determining key legislation work, the SAMR made arrangements in four key areas by taking into account the new situation and new tasks of market regulation: First, thoroughly implement the policy of fair competition and constantly optimize the environment for fair competition, promote the formulation of the Regulations on Fair Competition Review, and revise the Provisions on Prohibiting Abuse of Intellectual Property Rights to Eliminate and Restrict Competition and other regulations. Secondly, continue promoting the facilitation of market access and market exit, constantly optimize business environment and improve normal supervision of the platform economy, formulate and revise the Measures for the Implementation of Management of Enterprise Name Registration, the Provisions on the Supervision and Administration of Fulfilling Primary Responsibilities of Compliance Management by Internet Platform Enterprises, the Interim Measures for the Examination and Administration of Advertisements of Drugs, Medical Instruments, Health Food and Food for Special Medical Purpose and other regulations. Thirdly, strictly implement safety responsibilities in food, drugs, key industrial products and special equipment and further strengthen safety guarantee in market supervision, actively promote the revision of such administrative regulations as the Regulations for the Implementation of the Drug Administration Law and the Regulations on the Protection of Traditional Chinese Medicine Species, and formulate and revise the Measures for the Administration of Food Business Licensing and Filing, the Measures for the Quality Supervision and Administration of Drug Distribution and Use and other regulations. Fourthly, give full play to the supporting role of quality and accelerate the construction of a country strong on quality, actively promote the revision of the Law of Product Quality and the Regulations on Certification and Accreditation, and revise the Measures for the Administration of National Metrological Verification Regulation, the Measures for the Administration of Industry Standards and other regulations.

In advancing key legislation work, the SAMR will, in strict accordance with the provisions of the Legislation Law, the Regulations on the Procedure for Formulating Administrative Regulations and the Regulations on the Procedure for Formulating Rules, further promote scientific, democratic and law-based legislation, strive to improve the quality and efficiency of legislation, make legislation more systematic, integrated, coordinated and timely, and promote the formation of a comprehensive, scientific, standardized and effective legal system for market regulation.
