In order to further strengthen the quality and safety supervision of solid beverages, safeguard the legitimate rights and interests of consumers, and protect the health of the public, in accordance with the Food Safety Law of the People's Republic of China and the Law of the People's Republic of China on the Protection of Minors, the relevant matters are announced as follows:
1. The manufacturers of solid beverages shall organize production in strict accordance with the relevant laws, regulations, standards and specifications of food safety, possess production conditions and inspection control capabilities that are compatible with the products produced, and strictly control the production process to ensure food safety.
2. The name of solid beverage shall not be the same as that of the special food that has been approved; the specific name "solid beverage" shall be prominently marked on the product label to reflect the true nature of the food, and the font size shall be no smaller than other words on the same display panel (including words contained in trademarks and patterns).
3. For solid beverages directly offered to consumers, such as powdered protein beverage, powdered botanical beverage, powdered beverage for special uses, powdered flavored beverage and solid beverage with edible strains, "this product cannot replace special foods such as food for special medical purpose, infant and young children formulas and health food" shall also be marked as warning message on the same display panel of the minimum sales unit, whose covered area shall be no less than 20% of the panel. The warning word shall be printed in bold and has a clear color difference with the background.
4. It is not allowed to express, imply or emphasize that the product is suitable for specific groups such as minors, elderly, pregnant women, patients, and people with nutritional risk or malnutrition using words or patterns on solid beverage labels, instructions and promotional information; it is not allowed to express or imply disease prevention and treatment functions, health functions or meeting the special needs of people with specific diseases using production process or raw material names.
5. Encourage industry associations and other social organizations to play the role of industry guidance and self-discipline, to regulate the production, sale and promotion of enterprises; encourage schools to strengthen food safety and nutrition health education for minors, and advocate consumers such as parents to get scientific cognition and rational consumption. If any organization or individual finds violations of food safety or infringement on the interests of consumers involved in violation the provisions of this announcement, please call "12315" to complain and report.
This announcement will come into force on June 1, 2022. The products produced before this date can continue to be sold during their shelf life.
