In order to regulate the management of health food sign and safeguard the legitimate rights and interests of consumers, on March 21, 2022, the SAMR issued the Announcement of the State Administration for Market Regulation on Strengthening the Management of Health Food Sign (Draft for Comments) to solicit public comments. The deadline for comments is April 21, 2022. The details are as follows:

l  First, the health food sign is exclusive for health food that has been registered or filed according to law, and shall be marked on the smallest sales package of health food.

l  Second, the health food sign shall be the pattern prescribed by the SAMR and be marked on the top left of the main display panel in equal proportion, which should be clear and easy to identify.

When the surface area of the main display panel is larger than 100 cm2, the width at the widest part of the health food sign shall not be less than 2 cm. When the surface area of the main display panel is less than or equal to 100 cm2, the width at the widest part of the health food sign shall not be less than 1 cm.

l  Third, the overall proportion of the health food sign is 12:10 (height: width= 6:5). The scale factor of overall height of the hat pattern is 7.1 and that of the width is 10; the scale factor of the diameter of the middle sphere pattern is 3.7; the scale factor of the height and width of the word "health food" is 2.4. The color value of printing standard color CMYK is C100 M40 Y0 K15, and the color value of screen standard color RGB is R0 G106 B176. The font is bondface.

l  Fourth, health food producers and operators can use health food sign in the production and operation sites, special counters and other locations. Health food sign can be changed in proportion according to the actual needs, but shall not be deformed or discolored. Non-health food products shall falsely or fraudulently use the health food sign.

l  Fifth, holders of the health food approval certificate and record certificate and health food producers and operators should ensure that the health food sign is marked on health food on the market as required. Market supervision and management departments at all levels should strengthen the supervision and management of health food sign.

This announcement will take effect on December 1, 2022. Previously manufactured products can be sold to the end of their shelf life.
