Case| The Requirements for Imported Foods in China

The Food Safety Law clarifies requirements for food product exported to China. The article 92 of Food Safety Law indicates that imported food, imported food additive, and imported food-related product should comply with China national food safety standards. Imported food and imported food additive should be qualified by entry-exit inspection and quarantine institutions in accordance with the relevant laws and regulations on import and export commodity inspection. Imported food, and imported food additive should be accompanied by qualified certification materials in accordance with the requirements of the national entry-exit inspection and quarantine departments. The article 97 stipulates that imported prepackaged food, imported food additives should have Chinese labels. If instruction is required by laws or regulations, the instruction in Chinese shall be provided. Labels, instructions should comply with this law, other relevant laws, administrative regulations and national food safety standards, and should contain the origin of the food, and the name, address and contact information of the domestic agent. Moreover, it is very important to confirm the compliance of food ingredients. The article 38 of Food Safety Law states that no medicine may be added to food under production or trade, but substances that are traditionally both food and traditional Chinese medicinal materials may be added. This provision also applies to imported food.

In a case, an imported food label did not indicate the name, address, and contact information of the domestic agent, which violated the requirements for imported food in the Food Safety Law. On the other hand, this product is general food, illegally added epimedium and cod liver oil, and it did not meet the food safety standards. Eventually it was sentenced to refund and pay ten times of the price for compensation.
